Recent Family Court statistics reveal that there are currently more than 80,000 children caught up in private family law proceedings. In 2022, the case duration in private family law was 44.9 weeks.
These children will be waiting for crucial decisions to be made about their futures, including where they will live, how much time they will spend with each of their parents and where they should go to school. The number of children involved, and the average wait of almost a year for decisions to be made, shows the scale of the crisis facing the Family Courts.
For some of these families, court proceedings will be inevitable. But much more needs to be done at the earliest possible stage to triage cases, educate parents about their options, and explore, with professional help, whether any alternative means of resolving their dispute may be safe for them and worth attempting first.
Early legal advice can give parents the confidence to walk away from the adversarial courts system, and instead work together to find a solution which works for their family as a whole.
