The ‘No Order Principle’
The ‘no order principle’ is a principle family judges have to apply in every case concerning children which comes before them.
It simply means that the court will only interfere if that would be better for the child than making no court order at all.
So what does that mean for you?
Well, if you both agree the arrangements for your children, the court will not interfere. There is no supervisory element, as there is when it comes to your finances, to ensure your agreement is legally fair. Unless you both fundamentally disagree, and ask a judge to interfere in your family life, they won’t.
