How Do We Make Our Financial Deal Legally Binding?


If you are agreed you want to resolve your finances once and for all, then the best way forward is to draw up a ‘Consent Order’, which you then submit to the Family Court for approval.

Please note, the court will only approve a deal it regards as fair and it will want to know the details of your finances and the effect of what you’re proposing before it will do so. Once the court approves your order it will be final (other than in certain very limited circumstances, for example where there has been serious non-disclosure), so it will be absolutely vital for most couples to have taken expert legal advice well in advance.
