What Is a ‘Clean Break’?


It is the dismissal of one’s spouse’s financial claim against the other on divorce. It can be in relation to capital, or income or both.

The phrase ‘clean break’ has entered the lexicon for many divorcing couples, before they’ve got anywhere near seeing a lawyer. But what does it actually mean?

It is an order which dismisses your respective claims against each other, whether as to capital or income, meaning neither of you can bring further claims against the other in the future.

In every case, the court must strive to achieve this if it is possible (for which read fair) to do so. But it will not always be fair.
